1. Service Description

Markus Schäfer, trading as getdisco ("disco," "we," "us"), provides an AI-guided product discovery platform that helps product teams make evidence-based decisions. Our service transforms feature requests into validated problem statements through structured discovery conversations.

2. Card Reservation & Early Alpha Program

During our pre-launch phase, you may reserve your spot as a early alpha by saving a payment method. By doing so, you agree to the following:

  • Your card is saved but not charged until the product officially launches.
  • As a early alpha, your early-access pricing is locked in for the lifetime of your subscription.
  • You will be notified at least 7 days before any charge is processed.
  • You may cancel your reservation at any time before launch with no obligation.

3. Right of Withdrawal (Widerrufsrecht)

If you are a consumer within the European Union, you have a statutory right of withdrawal pursuant to § 312g BGB:

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Markus Schäfer, trading as getdisco, Email: support@getdisco.dev) of your decision to withdraw from this contract by an unequivocal statement (e.g., an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal:

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

4. Refund Policy

In addition to your statutory right of withdrawal, we offer a 100% money-back guarantee, no questions asked. If you are not satisfied with disco after launch, you may request a full refund within 30 days of your first charge. To request a refund, contact us at support@getdisco.dev. This guarantee does not limit your statutory withdrawal rights.

5. Cancellation

Before launch: You may cancel your early alpha reservation at any time through your account settings or by contacting support@getdisco.dev. No charges will be applied.

After launch: You may cancel your subscription at any time. Your access will continue until the end of your current billing period. No partial refunds are issued for unused time within a billing cycle, except under the 30-day money-back guarantee.

6. Account Terms

You must be at least 18 years old to use disco. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to keep your account information up to date.

7. Intellectual Property

The disco platform, including its software, design, and documentation, is the intellectual property of Markus Schäfer, trading as getdisco. You retain full ownership of all data you input into disco, including discovery conversations, problem statements, and evidence data. We will never claim ownership of your content.

8. Limitation of Liability

We are liable without limitation for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, body, or health (§ 309 Nr. 7a BGB), and under mandatory statutory provisions such as the Product Liability Act (Produkthaftungsgesetz). For slight negligence, we are only liable in case of breach of a material contractual obligation (Kardinalpflicht), limited to foreseeable, contract-typical damages. In such cases, our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. We shall not be liable for indirect, incidental, or consequential damages except as required by the foregoing provisions.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Germany. For consumers, the mandatory consumer protection provisions of their country of residence apply additionally (Art. 6(2) Rome I Regulation). The exclusive place of jurisdiction for merchants (Kaufleute) shall be Berlin, Germany. For consumers, the statutory jurisdiction rules apply.

10. Changes to These Terms

We may update these Terms of Service from time to time. If we make material changes, we will notify you at least 30 days in advance via email to the address associated with your account. Your continued use of the service after the notice period constitutes acceptance of the updated terms. If you do not agree with the changes, you may terminate your account before the changes take effect.

11. Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely achieves the economic purpose of the invalid provision.
